Organ Donation Leave

Absences for those who serve as bone marrow or organ donors, are to be treated as paid leave, not charged against vacation or sick accruals, of up to five (5) work days for a bone marrow donor, or up to thirty (30) days for an organ donor.  Verification of such donation is to be provided by the physician or hospital involved in the donation.  Such leave is to be provided without loss of pay, benefits, accruals, or overtime accumulation.  The organ donations specified in the bill include lung, liver, pancreas, kidney, intestine, or other organ "that requires continuous circulation of blood to remain useful for purposes of transplantation."  We presume that absences related to these events may also be designated as FMLA, if eligible.  Leave codes exist for Bone Marrow Donor and Organ Donor, in order to record and track this paid leave when provided.
