The
bill states that the eighth member shall be a member of the faculty of an
institution of higher learning under the control of the board.
The
proposed committee amendment reads: The term of the member who is a member of the faculty of an institution
of higher learning under the control of the board shall be for two years. The
membership position held by a faculty member shall rotate among the
institutions of higher learning under the control of the board and the
institutions whose faculty members shall serve the first and second two-year
terms on the board shall be determined by lot.

1 Section 1.
Section 262.1, Code 2001, is amended to read as
1 2 follows:
1 3 262.1
MEMBERSHIP.
1 4 The state board of regents consists of
nine members, eight
1 5 seven of whom
shall be selected from the state at large solely
1 6 with regard to their
qualifications and fitness to discharge
1
7 the duties of the office. The eighth member shall
be a member
1 8 of the faculty of
an institution of higher learning under the
1
9 control of the board. The ninth member shall be
a student
1
10
enrolled on a full-time basis in good standing at either the
1
11
graduate or undergraduate level at one of the institutions
1
12
listed in section 262.7, subsection 1, 2, or 3, at the time of
1
13 the
member's appointment. Not more than five
members shall be
1
14 of
the same political party.

15 Sec. 2.
Section 262.6, Code 2001, is amended to read as
1
16
follows:

17 262.6
VACANCIES.
1
18 Vacancies shall be filled in the same
manner in which
1
19
regular appointments are required to be made.
If the ninth
1
20 member
resigns prior to the expiration of the term, the
1
21 individual
appointed to fill the vacancy shall meet the
1
22 requirements
for the ninth member specified in section 262.1.
1
23 Other
vacancies occurring prior to the expiration of the ninth
1
24 member's
term shall be filled in the same manner as the
1
25 original
appointments for those vacancies.

26 EXPLANATION
1
27 This bill provides that one of the nine
members of the
1
28 state
board of regents must be a member of the faculty of an
1
29
institution of higher learning under the control of the board.
1 30 The bill also removes
redundant language from a Code provision
1 31 that specifies how
vacancies on the board must be filled.
