Sample Sublease Agreement
Definitions:
Sublessor = Original Tenant
Sublessee = New Tenant
It is mutually agreed on this ___________(month/day/year) by and between _______________ (sublessor(s)), and _______________ (sublessee(s)), that the lease described below shall be sublet to (sublessee(s)).
Sublessee(s) hereby acknowledge receipt of a copy of the lease and agree to be bound to the terms of said lease effective ____________(month/day/year). Any waiver or modification of this agreement shall be in writing.
The sublessor(s) shall remain liable for the terms of the original lease, including any damages to the leased property.
Choose one (A, B, or C):
- The security deposit of the sublessor will remain in the landlord’s possession until the expiration of the lease.
- Landlord agrees to return sublessor’s security deposit in the amount of $______. Sublessee agrees to pay to the landlord $_______ as a security deposit, which the landlord agrees to return to the sublessee upon the expiration of the lease if there are no damages to the rental unit and no unpaid rent.
- Sublessee agrees to pay sublessor $______ security deposit. Landlord acknowledges the transferal of the security deposit and agrees to return the security deposit to the sublessee upon the expiration of the lease if there are no damages to the rental unit and no unpaid rent.
